Agreement and Scope

These Terms govern access to and use of hosting, VPS, domains, and related services; by ordering or using services, the customer accepts these Terms and related policies.

Eligibility and Account Security

Clients warrant legal capacity to contract, maintain accurate registration data, and keep credentials confidential; unauthorized access resulting from negligence remains the client’s responsibility.

Service Provision and Availability

Services are provided on an “as is” and “as available” basis without warranties of uninterrupted operation; maintenance and third‑party network issues may impact availability.

Customer Content and Responsibility

Clients are solely responsible for content, legality, and rights; Hostyt may act on valid legal requests and enforce policies against illegal content consistent with DSA.

Payments, Billing, Refunds

• Prepaid billing; recurring invoices issued prior to renewal; late or unpaid invoices may lead to suspension and termination.
• Refunds: shared hosting within 30 days; other hosting within 72 hours; domains and custom work non-refundable.
• Chargebacks may trigger immediate suspension pending resolution.

Acceptable Use and Enforcement

Use must comply with the Acceptable Use Policy; violations may result in warnings, throttling, suspension, or termination without notice for egregious abuse.

DSA Compliance—Notice, Action, Reasons

Hostyt provides a user-accessible notice-and-action channel for alleged illegal content and issues statements of reasons when removing or restricting content, processed diligently, objectively, and in a timely manner.

Where any service qualifies as an online platform, additional DSA transparency database submissions of statements of reasons may apply.

Law Enforcement and Threats

Hostyt cooperates with competent authorities and will report suspected criminal offences involving threats to life or safety as required under DSA Article 18.

Verification and Fraud Controls

Hostyt may request additional information to prevent fraud or abuse where necessary and proportionate to risk.

Suspension and Termination

Hostyt may suspend or terminate services for policy or legal violations, security risks, or non-payment; data may be irrecoverably deleted upon termination.

Limitation of Liability and Indemnity

Hostyt is not liable for indirect, incidental, consequential, or lost profit damages; clients indemnify Hostyt for claims arising from their content or violations.

Restricted Countries

Services are not provided to residents or entities of Russia, Iran, or North Korea; related accounts may be suspended and terminated.

Pricing and Changes

Hostyt may adjust pricing, plans, and features effective on new orders or renewals; material Terms changes will be communicated and reflected by the “Last Updated” date.

Governing Law and Forum

Polish and EU law govern; competent courts in Warsaw, Poland have jurisdiction over disputes to the extent permitted by law.
