1. Agreement
These Terms of Service govern access to and use of Hostyt, host.yt, customer accounts, support channels, billing functions, and any hosting, VPS, domain, DNS, security, email, reseller, affiliate, or related services that we provide.
By creating an account, placing an order, using a service, renewing a service, or accepting these terms electronically, you agree to be bound by these Terms and by the policies incorporated by reference.
2. Incorporated documents
The following documents form part of the agreement where applicable: Hosting Agreement, VPS and Server Terms, Domain Registration Agreement, Domain Transfer Agreement, Acceptable Use Policy, Abuse Policy, Privacy Policy, Cookie Policy, Data Processing Addendum, Backup Policy, Fair Use Policy, SLA, Refund and Cancellation Policy, Security Policy, DSA Notice and Action Policy, and any product-specific terms shown at checkout or inside the customer panel.
3. Eligibility
You must be at least 18 years old and have legal capacity to enter into binding contracts. If you act for a company or organisation, you confirm that you are authorised to bind that entity.
You must not use the Services if you are prohibited from doing so by applicable sanctions, export-control rules, court orders, regulatory restrictions, or local law.
4. Account ownership and security
The person or legal entity shown in the account profile is treated as the account holder unless we reasonably determine otherwise. You must keep account, billing, tax, domain registrant, and contact data accurate and current.
You are responsible for all activity in your account, including activity by staff, contractors, customers, clients, API tokens, scripts, integrations, or compromised credentials. You must use strong passwords, keep credentials confidential, and enable available security controls where appropriate.
You must notify us immediately at support@host.yt if you suspect unauthorised access or a security incident affecting your account.
5. Orders, billing, taxes, and renewals
Services are normally sold on a prepaid subscription basis unless stated otherwise. Fees, currencies, tax treatment, setup fees, renewal prices, and product limits may be shown on the website, in the customer panel, on an invoice, or during checkout.
You authorise us and our payment processors to charge the selected payment method for orders, renewals, upgrades, usage-based fees, recovery fees, administrative fees, chargeback costs, and other amounts due under the agreement.
You are responsible for applicable taxes, duties, reverse-charge obligations, VAT/GST numbers, invoice data, and any withholding or local tax reporting obligations that apply to your purchase or resale of the Services.
Auto-renewal may be enabled for eligible services. If you disable auto-renewal or payment fails, the affected service may expire, be suspended, be deleted, or become subject to recovery fees.
6. Service use
You must use the Services lawfully, responsibly, and in accordance with our Acceptable Use Policy, Abuse Policy, Fair Use Policy, product limits, and any applicable third-party provider rules.
You are responsible for your websites, applications, files, scripts, data, email, databases, DNS zones, domains, logs, software, plugins, customers, and end users.
7. Customer content
You retain ownership of your content. You grant us a limited licence to host, transmit, store, cache, back up, scan, secure, troubleshoot, display, process, and otherwise handle your content as necessary to provide, protect, improve, and support the Services.
You confirm that you have all rights, permissions, and legal bases needed to upload, store, process, transmit, publish, or otherwise use your content through the Services.
8. Monitoring and enforcement
We do not generally pre-screen customer content. We may, however, investigate abuse reports, security events, payment disputes, legal requests, DSA notices, IP infringement notices, malware signals, network incidents, excessive resource use, and suspected breaches.
Where necessary, we may suspend, restrict, throttle, isolate, remove, disable, preserve, or terminate content, accounts, domains, IP addresses, virtual servers, DNS records, email services, API access, or other service components.
9. Third-party services
Some Services may rely on third-party data centres, registries, registrars, payment processors, anti-fraud providers, control panels, security tools, software vendors, or connectivity providers. You must comply with terms that apply to those third-party components.
10. Beta, experimental, and preview features
Beta or preview features are provided as-is and may change, break, be rate-limited, be discontinued, or produce unexpected results. You must not rely on beta features for production workloads unless we expressly state otherwise.
11. Support
Support is provided through the channels listed on host.yt. We aim to respond to support requests within 48 hours, but response times can vary based on queue volume, plan level, incident severity, and required investigation.
Support does not include custom development, debugging third-party code, legal advice, business consulting, SEO work, content creation, or administration of software that is outside the managed scope of your plan.
12. Suspension and termination
We may suspend or terminate Services for non-payment, chargebacks, abusive use, excessive resource consumption, security risk, inaccurate account data, legal requirements, sanctions risk, violation of policy, or operational reasons needed to protect the platform.
You may cancel eligible services from the customer panel or by contacting support. Cancellation does not automatically entitle you to a refund unless the Refund and Cancellation Policy provides one.
13. Disclaimers
Except where expressly stated in a written SLA or mandatory law, the Services are provided on an “as is” and “as available” basis. We do not guarantee that every service will be uninterrupted, error-free, secure from all threats, or suitable for a specific regulated purpose.
14. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, punitive, consequential, or business-loss damages, including loss of profit, revenue, goodwill, opportunity, data, or content.
To the maximum extent permitted by law, our total aggregate liability for a claim is limited to the fees you paid for the affected Service during the 12 months before the event giving rise to the claim, or EUR 1,000, whichever is lower, unless mandatory law requires a different limit.
15. Indemnity
You agree to defend and indemnify us against claims, costs, losses, penalties, damages, and reasonable legal fees arising from your content, your customers, your use of the Services, your breach of the agreement, or your violation of third-party rights or applicable law.
16. Governing law and disputes
Unless mandatory consumer protection law provides otherwise, this agreement is governed by the law of the jurisdiction of Marko Omelyash VARSOFIA‘s registered office. The parties will first try to resolve disputes in good faith through support, billing, or legal contact channels.
