DMCA Policy

Hostyt respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe that content hosted on our platform infringes your copyright, you may submit a written takedown notice as described below.

1. How to Submit a DMCA Takedown Notice

Your notice must include all of the following elements to be valid under the DMCA (17 U.S.C. § 512(c)(3)):

1. A description of the copyrighted work you claim has been infringed, or a representative list if multiple works are at a single site.
2. The exact URL(s) or precise location of the allegedly infringing material so we can locate it.
3. Your full name, postal address, telephone number, and email address.
4. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
5. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
6. Your electronic or physical signature.

Incomplete notices may not be processed. We are not required to act on incomplete or defective notices.

2. Our Response

Upon receipt of a valid, complete notice, we will:

• Acknowledge receipt within a reasonable time
• Investigate the claimed infringement
• Remove or disable access to the allegedly infringing content if the notice is valid
• Notify the hosting user of the action taken

3. Counter-Notice

If content belonging to you was removed as a result of a DMCA notice and you believe the removal was in error, you may submit a counter-notice. A valid counter-notice must include:

1. Your full name, address, telephone number, and email address.
2. Identification of the content that was removed and its location before removal.
3. A statement under penalty of perjury that you have a good-faith belief the content was removed by mistake or misidentification.
4. Your consent to the jurisdiction of the applicable federal court.
5. Your electronic or physical signature.

Upon receipt of a valid counter-notice, we may reinstate the removed content after 10–14 business days unless the complaining party seeks a court order.

4. Repeat Infringers

Hostyt maintains a policy of terminating accounts of users who are determined to be repeat infringers of intellectual property rights, in appropriate circumstances.

5. False Notices

Submitting a materially false DMCA notice or counter-notice may result in liability for damages, including costs and attorney’s fees, under 17 U.S.C. § 512(f).

6. EU Notice

For users in the EU, copyright complaints may also be processed under our Notice & Action Policy in accordance with the EU Digital Services Act.
