Notice & Action Policy

This policy describes how Hostyt handles notices of allegedly illegal content hosted on our infrastructure, in compliance with the EU Digital Services Act (DSA, Regulation 2022/2065), Articles 16–18.
Hostyt operates as an intermediary hosting service provider. We do not proactively monitor hosted content, but we process notices diligently when received.
1. How to Submit a Notice
Submit notices electronically to: legal@host.yt (subject: “DSA Notice of Illegal Content”)
A complete notice must include:
- Your identity: your name and contact email address for follow-up communications. Anonymous notices will not be processed.
- Content location: the exact URL(s) or other precise identification (e.g. IP address, timestamps, port) of the allegedly illegal content.
- Reason for illegality: a clear explanation of why the content is alleged to be illegal, with references to the applicable legal provision (EU, Polish, or international law).
- Good-faith statement: a statement that you believe in good faith that the information is accurate and that you are authorized to submit the notice.
Incomplete notices may be rejected. We will notify you of the reason for rejection where feasible.
2. Processing & Timelines
Upon receipt of a complete notice, Hostyt will:
- Acknowledge receipt promptly
- Review the notice diligently, objectively, and in a timely manner
- Assess whether the reported content is illegal under applicable law
- Take appropriate action (see §3) or reject the notice with a reasoned explanation
3. Possible Actions
Depending on the assessment, Hostyt may:
- Remove or disable access to the content
- Apply geo-blocking or access restrictions
- Suspend or terminate the hosting account
- Take no action (if the content is found to be lawful)
4. Statement of Reasons
When Hostyt restricts, removes, or takes action against content or an account, we issue a statement of reasons to the affected hosting user. This statement includes:
- The decision taken and the type of restriction applied
- The facts and circumstances relied upon
- Whether automated detection tools were used
- The applicable legal or contractual grounds
- Available redress options
5. Appeals
If you are a hosting user affected by a content restriction decision, you may appeal by contacting legal@host.yt with a written explanation. Appeals are reviewed independently from the original decision. Where applicable, you may also refer disputes to a competent judicial or administrative authority.
6. Reporting to Law Enforcement
If Hostyt becomes aware of information indicating a potential criminal offence involving threats to life or safety, we will report it to the competent Polish law enforcement authority as required by DSA Article 18.
7. Notices Submitted in Bad Faith
Submitting false or abusive notices may violate Polish law and EU law. Hostyt reserves the right to suspend processing of notices from parties who repeatedly submit manifestly unfounded notices.
