Terms of Service

These Terms of Service (“Terms”) govern the use of hosting, VPS, domains, email, and related services (“Services”) provided by Hostyt (Business Registry: 389082189  ·  VAT: PL7011036703). By placing an order or using the Services, you accept these Terms and all referenced policies.

1. Definitions

  • Hostyt / we / us: Hostyt, the operator of host.yt and my.host.yt
  • Client / you: any natural person or legal entity that orders or uses the Services
  • Consumer: a natural person acting outside their business or professional activity
  • B2B Client: a business or sole trader acting in a professional capacity

2. Eligibility & Account Security

You warrant that you have the legal capacity to enter into a binding agreement. You are responsible for maintaining the confidentiality of your account credentials. Unauthorized access or losses resulting from your negligence remain your responsibility. Providing false registration data is grounds for immediate termination.

3. Service Provision

Services are provided on an “as is” and “as available” basis. Scheduled maintenance, third-party network issues, and force majeure events (floods, acts of war, state of emergency, pandemic, infrastructure failure beyond our control) may impact availability. Specific uptime commitments, where applicable, are set out in our SLA documentation.

4. Acceptable Use

Use of the Services must comply at all times with our Acceptable Use Policy (AUP). Violations may result in warnings, traffic throttling, suspension, or immediate termination for egregious or repeated abuse.

5. Payments & Billing

  • Services are billed on a prepaid basis. Invoices are issued electronically; by accepting these Terms you consent to receiving electronic invoices.
  • Payment is due immediately upon order. Renewal invoices are issued prior to the renewal date.
  • Unpaid invoices may result in service suspension after reasonable notice, and termination with irrecoverable data deletion if unpaid within 30 days of suspension.
  • Chargebacks or payment disputes may trigger immediate account suspension pending resolution.

6. Refunds & Consumer Withdrawal Right

  • Consumers (B2C): You have a statutory 14-day right to withdraw from a distance contract without giving reasons, unless the service has been fully performed with your explicit prior consent and you acknowledged losing the withdrawal right. To exercise this right, notify us at support@host.yt. Refunds are processed within 14 days using your original payment method.
  • Shared hosting (B2B & B2C after withdrawal period): 30-day money-back guarantee from the date of activation.
  • VPS & dedicated services: 72-hour refund window from activation.
  • Domain registrations, renewals, transfers: non-refundable once processed with the registry.
  • Custom work, setup fees, SSL certificates: non-refundable.

Refund requests must be submitted to support@host.yt with your order ID and registered email address.

7. Customer Content & Responsibility

You are solely responsible for all data, software, and content hosted on your services — including its legality, accuracy, and intellectual property rights. Hostyt does not proactively monitor content. We may act on valid legal requests or enforce our policies when illegal content is reported.

8. Domain Services

Domain registrations are subject to the rules of the relevant registry (e.g. NASK for .pl domains, ICANN policies for gTLDs). Hostyt acts as a reseller. Registrant obligations, suspension, and cancellation terms are governed by the applicable registry regulations. Domains are non-refundable once registered with the registry.

9. Suspension & Termination

  • Hostyt may suspend or terminate services for: policy or legal violations, security risks, non-payment, or providing false identity information.
  • Upon termination, account data may be irreversibly deleted after 21 days. Backups, if retained, are deleted within a further 14 days.
  • For B2B clients, Hostyt may terminate the contract immediately without cause with 30 days’ notice. Immediate termination without notice applies in cases of AUP violation, non-payment, or legal requirements.
  • B2C consumer contracts are subject to applicable statutory protections.

10. Restricted Services

Services are not provided to residents or entities in Russia, Belarus, Iran, or North Korea, or to parties on EU/UN sanctions lists. Related accounts may be suspended and terminated immediately.

11. DSA Compliance

Hostyt operates a notice-and-action mechanism for allegedly illegal content in accordance with EU Regulation 2022/2065 (Digital Services Act). Notices may be submitted to legal@host.yt. When content is removed or restricted, Hostyt issues a statement of reasons. Recipients may appeal decisions. Hostyt will report suspected criminal offences involving threats to life or safety to competent authorities as required by DSA Article 18.

12. Limitation of Liability

  • Hostyt is not liable for indirect, incidental, consequential, special, or punitive damages, or for loss of profits, revenue, data, or business opportunities.
  • For B2B clients, total aggregate liability is capped at the greater of the amount paid in the 3 months preceding the event giving rise to the claim or €500.
  • Statutory consumer protections are not limited or excluded by these Terms.
  • Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or where exclusion is prohibited by mandatory law.

13. Indemnification (B2B)

B2B clients indemnify Hostyt against third-party claims, losses, and costs (including reasonable legal fees) arising from their content, violations of these Terms, or breach of applicable law.

14. Verification & Fraud Controls

Hostyt may request additional verification information to prevent fraud, comply with legal obligations, or manage risk. Refusal to provide such information may result in service suspension.

15. Pricing & Changes

Prices may be adjusted with 30 days’ notice for B2B clients. B2C consumers may terminate the contract within the notice period if a price increase is material. Promotional pricing is not combined unless stated. Changes to these Terms are indicated by the “Last Updated” date; material changes are communicated to registered account holders.

16. Severability & Entire Agreement

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force. These Terms, together with referenced policies (AUP, Privacy Policy, Refund Policy, Cookie Policy, DPA where applicable), constitute the entire agreement between the parties.

17. Governing Law & Disputes

These Terms are governed by the law of the Republic of Poland. For disputes not resolved amicably, the competent courts in Warsaw, Poland have jurisdiction. Consumer protections under the consumer’s country of residence apply where they provide greater rights than Polish law.

18. Complaints

Complaints should be submitted in writing to support@host.yt. We aim to respond within 14 days. Unresolved consumer disputes may be referred to the Trade Inspection authority (Inspekcja Handlowa) or the EU online dispute resolution platform at ec.europa.eu/consumers/odr.
